(participant, parent/legal guardian) acknowledge that direct participation in
and/or observance of the activities of the Island Tennis Association (“ITA”)
involves risk, known and unknown, of physical or other injury due to the inherent
nature of this sporting activity.
Before participating in this event, in using the facilities as either a
participant or spectator, in every instance I agree to inspect the premises in
advance, so as to discover any natural or unnatural condition on the premises,
which may affect the course of safe play and safe observance of play. I expressly agree that any condition
existing on the premises which may constitute an impediment to safe play or
safe observance of play shall be deemed an open and obvious condition, and I
expressly relieve ITA from any obligation to warn me or my Family members or my
guests of any potentially unsafe condition, known or unknown, at any time.”
“I do hereby also agree
for myself, my heirs, executors, administrators, insurers, medical providers,
creditors and assigns, to indemnify and hold harmless the Island Tennis
Association, its past, present and future officers, members, agents, employees,
insurers, successors and assigns, owners, predecessors and successors in
interest, and all other related persons, firms or corporations, from and of any
and all claims, demands, actions, causes of action or suits of any kind or
nature whatsoever which may arise from my participation in this activity. Such indemnification shall also include any
attorney’s fees, court costs, and other expenses incurred in defending or
opposing any such claims, demand, actions, liability, damages, judgment or
losses.”
